Terms & Conditions

(1) DEFINITIONS

Teacher(s) shall mean any person hosting or facilitating a retreat or workshop or organizing or leading a person/s for an event at Bodhi Khaya retreat CC (hereafter Bodhi Khaya). Participant(s) shall mean any person attending a retreat or workshop or any other event at Bodhi Khaya. Guest(s) shall mean any independent person booking a personal stay at Bodhi Khaya. Client(s) shall mean Teachers, Participants, Organizers, Guests and any other person engaging the services offered by Bodhi Khaya. Days shall mean calendar days and months shall mean calendar months.

(2) BUSINESS

Bodhi Khaya is a business in the hospitality, wellness and education industry and offers a retreat venue to Teachers, Participants, Organizers, and Guests. Bodhi Khaya also hosts its own retreats and personal stays

(3) DELIVERY POLICY

Subject to availability and receipt of payment, requests will be processed within 10 days and delivery confirmed by way of a Registration ID.

(4) CLIENT PRIVACY POLICY

Bodhi Khaya shall take all reasonable steps to protect the personal information of Clients. For the purpose of this clause, "personal information" shall be defined as detailed in the Promotion of Access to Information Act 2 of 2000 (PAIA). (5) PAYMENT OPTIONS ACCEPTED

Payment may be made via Visa, MasterCard, Diners or American Express Cards or by bank transfer into the Bodhi Khaya bank account, the details of which will be provided on request.

(6) INTEREST

Interest will be charged at prime, as charged by First National Bank at the applicable time, plus 2% per month or part thereof for any amounts outstanding.

(7.1) CARD ACQUIRING AND SECURITY

Card transactions will be acquired for Bodhi Khaya via PayGate (Pty) Ltd who are the approved payment gateway for all South African Acquiring Banks. DPO PayGate uses the strictest form of encryption, namely Secure Socket Layer 3 (SSL3) and no Card details are stored on the website. Users may go to www.paygate.co.za to view their security certificate and security policy.

(7.2) CLIENT DETAILS SEPARATE FROM CARD DETAILS

Client details will be stored by Bodhi Khaya separately from card details which are entered by the client on DPO PayGate’s secure site. For more detail on DPO PayGate refer to www.paygate.co.za.

(8)  MERCHANT OUTLET COUNTRY AND TRANSACTION CURRENCY

The merchant outlet country at the time of presenting payment options to the cardholder is South Africa. Transaction currency is South African Rand (ZAR).

 (9) RESPONSIBILITY

Bodhi Khaya takes responsibility for all aspects relating to the transaction including sale of goods and services sold on this website, customer service and support, dispute resolution and delivery of goods.

(10) CANCELLATION BY BODHI KHAYA

Bodhi Khaya reserves the right to cancel any booking forthwith and without liability on its part in the event of any damage or destruction of the venue by fire or any other cause, any shortage of labour or food supplies, strikes, lockouts or industrial unrest, or any cause beyond our control which shall prevent Bodhi Khaya from performing its obligations in connection with any bookings.

(11) COUNTRY OF DOMICILE

This agreement is governed by the laws of South Africa and Bodhi Khaya chooses as its domicilium citandi et executandi for all purposes under this agreement, whether in respect of court process, notice, or other documents or communication of whatsoever nature:

(12) VARIATION

Bodhi Khaya may, in its sole discretion, change this agreement or any part thereof at any time without providing notice thereof.

(13) COMPANY INFORMATION

This website is run by Bodhi Khaya Retreat CC based in South Africa trading and with registration number 2006/110546/23 and member Georgina Hamilton Stevens.

(15)TERMS AND CONDITIONS FOR PARTICIPANTS AND GUESTS

(15.1) CANCELLATION AND REFUND POLICY  - PARTICIPANTS

  • Prior to 30 days – 100% refund
  • Less than 30 days – 90% refund
  • Less than 14 days  – 50% refund
  • Less than 48 hours – 50% refund will be provided in the form of a credit to be used at Bodhi Khaya within 12 months from the date of issue.

(15.2) CANCELLATION AND REFUND POLICY - GUESTS

  • Prior to 7 days – 90% refund
  • Prior to 3 days – 50% refund
  • Less than 48 hours – no refund

(15.3) INDEMNITY & WARRANTIES

The Participant and Guest shall hold blameless and indemnify Bodhi Khaya, its teachers, facilitators, community, directors/members, officers, employees, agents, independent contractors, representatives, subsidiaries, affiliates, controlling or holding companies and insurers past and present (“The Indemnified Parties”) who shall not be liable or responsible for any personal injury, harm, death, loss of support or any other damages of any nature whatsoever whether arising from negligence or any other cause whatsoever.

(16) TERMS AND CONDITIONS FOR TEACHERS, FACILITATORS AND ORGANISERS.

(16.1) DEPOSIT

A deposit of R5, 000.00 per retreat day is required. The minimum number of days for a retreat is 2 (Two). The deposit is required to confirm your booking and to set off any breakages or amounts due at the end of your retreat.

(16.2) CANCELLATION AND REFUND POLICY - TEACHERS, FACILITATORS AND ORGANISERS

(16.2.1) Cancellations by the Teacher,  will be treated as follows:

  • Prior to 90 days – 90% of deposit will be refunded.
  • Less than 90 days – 50% of deposit will be refunded in the form of a credit towards the Teacher’s next organized retreat. To be used within 24 months from the date of issue.
  • Less than 60 days no refund.

(16.2.2) Cancellations by the Participant will be treated as follows:

  • Prior to 30 days – 100% refund
  • Less than 30 days – 90% refund. The 10% retained will be held by Bodhi Khaya to offset administration costs.
  • Less than 14 days  – 50% refund. The 50% retained will be split 50:50 between the Teacher and Bodhi Khaya.
  • Less than 48 hours – 50% refund will be provided in the form of a credit to be used at Bodhi Khaya within 12 months from the date of issue. The retained 50% will be forwarded to the Teacher.

(16.3) LODGING

The number of Participants is to be confirmed by the Teacher 7 (Seven) days prior to commencement of the retreat for the purposes of catering and lodging. Bodhi Khaya reserves the right to alter guest lodging styles and rooms.

Exclusive use of the entire retreat centre is guaranteed for retreats hosting more than 33 participants.

In the event of a retreat hosting less than 33 participants, Bodhi Khaya reserves the right to host other retreats on the property or to alter the lodging options.

Dining facilities may be shared with other clients.

 (16.4) INDEMNITY & WARRANTIES

The Teacher shall hold blameless and indemnify Bodhi Khaya its teachers, facilitators, community, directors, members, officers, employees, agents, independent contractors, representatives, subsidiaries, affiliates, controlling or holding companies and insurers past and present (“The Indemnified Parties”) who shall not be liable or responsible for any personal injury, harm, death, loss of support or any other damages of any nature whatsoever in respect of either the Teacher or the Participant, whether arising from negligence or any other cause whatsoever.

The Teacher, Facilitator, or Organizer of a Retreat or Event, warrants that s/he has the necessary event and personal liability Insurance.
